ISDN Specific Terms and Conditions

These Specific Terms and Conditions are to be read in conjunction with our General Terms and Conditions of Supply.

  1. 1. DEFINITIONS
    1. Except as set out below, all definitions contained within these ISDN Terms and Conditions (the "Terms"), have the same meaning as those set out in the General Terms and Conditions of Supply.
    2. "Agreement" means these Terms, the Order, the Price List and the Product User Guide all of which, taken together, constitute the agreement between us for the supply of the Equipment and/or Services;
    3. "ISDN30e Service" means a high-performance voice and data service for businesses requiring more than 8 concurrent calls;
    4. "ISDN2e Service" means a high-performance voice and data service for businesses requiring between 2 and 8 concurrent calls and which can be provided as a ‘Digital Standard’ or a ‘Digital System’;
    5. "Digital Standard" means that the ISDN2e Service is configured to enable it to support Multi Subscriber Numbering ("MSN");
    6. "Digital System" means that the ISDN2e Service is configured to enable Direct Dial In ("DDI") numbering, to create a multi-line installation. Circuits configured in this manner can be linked together to form a larger single installation, of 4, 6 or 8 channels;
    7. "Minimum Cancellation Notice Period" means 30 days;
    8. "Minimum Service Period" means 12 months;
    9. "Network Termination Equipment" has the meaning given to it at clause 5.2;
    10. "Service" means the ISDN30e or ISDN2e Services provided by us in accordance with this Agreement; and
    11. "Service Period" means each 12 month period. Headings do not affect the interpretation of these Terms. References to the singular include the plural and vice versa. References to one gender include all other genders and vice versa.
  2. 2. THE SERVICES
    1. 2.1. We shall provide you with the Services and any Equipment subject to the terms of this Agreement.
    2. 2.2. The Service comprises:
      1. 2.2.1. for ISDN30e Services, an ISDN Line with between 8 and 30 x 64 Kbits channels for inbound and outbound voice and data services; or
      2. 2.2.2. for ISDN2e Services an ISDN line with 2 x 64Kbits channels for inbound and outbound voice and data services; and
      3. 2.2.3. an outbound voice calls service.
    3. 2.3. The ISDN30e Service terminates at a G704 (RJ45) interface for connection to your PBX or other equipment.
    4. 2.4. The ISDN2 service terminates at the network termination point ("NTP").
    5. 2.5. The signalling for the Service conforms to ETSI Q.931 standard for connection to approved equipment.
    6. 2.6. The Service supports up to 5 DDI ranges. All numbers in all ranges will have the same service profile.
    7. 2.7. A Single number DDI (SNDDI) is provided as an individual number DDI range. A maximum of 5 SNDDI, including the main number, will be provided.
    8. 2.8. The Service will not be available in the event that you have an existing carrier pre-select service.
  3. 3. AVAILABILITY
    1. 3.1. The Service is not available on:
      1. 3.1.1. the following BT services:
        1. 3.1.1.1. FeatureNet;
        2. 3.1.1.2. Light User;
        3. 3.1.1.3. Analogue DDI;
        4. 3.1.1.4. BT Basic;
        5. 3.1.1.5. BT Payphone lines;
        6. 3.1.1.6. switched multimegabit data service (SMDS) products; or
        7. 3.1.1.7. VPN FeatureNet services;
      2. 3.1.2. private circuits; and
      3. 3.1.3. such other services as may be identified by us from time to time.
  4. 4. ALLOCTION OF NUMBERS
    1. 4.1. We will allocate numbers for each of your ISDN Lines. The numbers allocated will be the next available numbers in the number range and cannot be chosen by you.
    2. 4.2. In the event that you want to retain your existing telephone number and such number is not currently connected to the Network, additional migration work may be required. We will have no responsibility for any delays in the commencement of the Services due to delay caused by the migration of your existing telephone number.
    3. 4.3. We will arrange for your phone number to be included within directory enquires and in the relevant BT telephone book for the area, upon request.
  5. 5. DEMARCATION AND LOCATION OF NTE
    1. 5.1. The Service rental is from the line card housed in a BT exchange (or any network telephony equipment which provides substantially the same function) to the Network Termination Equipment (NTE) at the Premises.
    2. 5.2. The Network Termination Equipment (NTE) means the end point of the network cable located either at:
      1. 5.2.1. the point at which the network cable arrives on the exterior of the Premises (but no higher than 1.5 m above ground level); or
      2. 5.2.2. within 3m of the entry of the network cable into the Premises, or the first reasonably available point on the network cable up to a maximum duration of one hour’s work from the time the engineer commences work on arrival at the Premises (provided that the one hour’s work will only be undertaken to the extent necessary for engineering or safety reasons).
    3. 5.3. The one hours work on site referred to at clause 5.2.2 relates only to the wiring at the Premises, not any work carried out off site.
    4. 5.4. The Network Termination Equipment will comprise one of the following:
      1. 5.4.1. an External Network Termination Equipment; or
      2. 5.4.2. a single or multi-line internal NTE; or
      3. 5.4.3. a single or multi-line termination box (Distribution Point).
    5. 5.5. External NTEs will be placed no higher than 1.5m above ground level, and any internal NTE will not be placed higher than 1.5m above floor level in the room in which it is sited.
    6. 5.6. The internal NTE will be located on a wall, shelf or rack within 3m of the entry point into the Premises as measured horizontally along the entry wall or any adjacent wall. Wiring will be surface run along skirting boards. For avoidance of doubt, the 3m will not cover service to a point 3m radially from entry.
    7. 5.7. Subject always to the restrictions set out in this clause, the engineer will fit the NTE as close as possible to where you require it to be sited. If this is not sufficient for your needs, you have the option to request a further visit from an engineer, via Customer Services, to fit extension wiring (at additional cost to you) or you may make your own arrangements with another supplier or use wireless technology.
    8. 5.8. Placing next to an electrical socket will make the use of DECT and wireless products more convenient. An electrical socket can normally be reached within 3M of the entry point and the engineer will take this into account when advising on engineering suitable entry points to the Premises.
    9. 5.9. You will be responsible for any internal wiring beyond the NTE. However, if an engineer is called to repair a fault which is beyond the NTE, the engineer will, where reasonably possible, at the time of repairing the wiring "regularise" the wiring to move the NTE to within the new demarcation point. This will not apply if the wiring has been routed within walls (for instance a previous new development). Additionally, re arrangement of wiring will only take place if it can be done as part of the normal appointment timescales. For instance, a line with excess internal wiring will be repaired by including an NTE at the correct location, and reconnecting the existing wiring and NTE.
  6. 6. FAULT RESPONSE
    1. 6.1. We offer two levels of fault response for this Service:
      1. 6.1.1. Standard; and
      2. 6.1.2. Premium
    2. 6.2. The default fault response option for the Service is Standard, unless you agree otherwise.
  7. 7. SERVICE PERIOD
    1. 7.1. We will activate the Services as soon as possible after we have accepted your Order and we have received any initial Charges due.
    2. 7.2. Subject to Clause 7.3, the Services will be provided for the Minimum Service Period from the date of activation unless:
      1. 7.2.1. we agree otherwise; or
      2. 7.2.2. the Services are terminated or suspended earlier in accordance with the terms of this Agreement.
    3. 7.3. On expiry of the Minimum Service Period the Services will, unless terminated earlier, automatically renew for subsequent 1 month Service Periods until they are terminated in accordance with this Agreement.
    4. 7.4. Subject always to clause 7.2, in the event that our supplier receives a valid order which relates to the line on which the Service is provided from another telecommunications provider:
      1. 7.4.1. you will be deemed to have provided notice to terminate the Service in accordance for the purposes of clause 7.2.2; and
      2. 7.4.2. we will terminate the Service in accordance with the standard industry practices.
  8. 8. CHANGES
    1. 8.1. We will use our reasonable endeavours to provide the Services for the relevant Service Period. However, we may have to suspend your access to the Services if we have to deal with technical problems, or to make improvements to the Service. We will let you know in advance where this occurs, unless the problem is urgent or an emergency.
  9. 9. CONDITIONS OF USE
    1. 9.1. You agree that you will promptly provide us with all information that we may reasonably require in order to provide the Services and to perform our other obligations under this Agreement. If you do not, or if you provide us with incomplete, incorrect, late or inaccurate information or instructions, we may cancel the Order by giving you written notice, or we may make an additional charge of a reasonable sum to cover any extra work that is required.
    2. 9.2. You agree that you will be responsible for all use of the Services and, where appropriate, you will be responsible for any additional equipment and/or services (including any telephones connected to the Services where such equipment has not been supplied by us as part of the Equipment); and for obtaining any permits and/or licences which may be necessary for connecting to, and accessing, the Services.
  10. 10. CHARGES
    1. 10.1. During the Service Period, you will be liable for:
      1. 10.1.1. channel rental, which will be invoiced monthly in advance; and
      2. 10.1.2. the costs of your calls, which will be invoiced monthly in arrears.
    2. 10.2. Where you are transferring an existing ISDN service, the transfer will be free of charge.
    3. 10.3. Where you require a new installation, you will also be liable to pay an installation charge in advance of the Service Commencement Date.
    4. 10.4. All amounts payable by you in accordance with the Agreement shall be payable either by direct debit, debit or credit card, cheque, BACS or CHAPS. All such amounts shall be exclusive of Value Added Tax ("VAT"), or any other applicable tax or duty, which shall be charged at the prevailing rate and shall be payable in addition to all such amounts due from you.
    5. 10.5. Where credit status is granted to you, you shall pay each invoice submitted to you, in full and in cleared funds, within 30 days of the date of such invoice to a bank account nominated in writing by us. Where credit status is not granted, you agree to pay each invoice submitted to it immediately upon receipt.
    6. 10.6. We may increase the amount payable by you for Services and/or Equipment by giving you one month's notice in writing.
  11. 11. YOUR RESPONSIBILITIES
    1. 11.1. You agree that any equipment connected to or used with the Services will bear the BABT mark and you will be responsible for ensuring that you do not exceed the appropriate REN value for your Service. You will be responsible for ensuring that all such equipment is technically compatible with the Services and is used in compliance with all relevant instructions and safety and security procedures.
    2. 11.2. You acknowledge and agree that the configuration of your on site equipment is your responsibility.
    3. 11.3. You agree that your on site equipment must be compatible with ETSI Signalling.
